Terms of Use
These terms are an agreement between you and us for using the Finalvue website and app (the “Service”). By creating an account or using the Service you agree to them. If you do not agree, do not use the Service. If you use the Service for a business, you agree on behalf of that business.
1. Who can use it
- You must be at least 18 and able to enter a binding contract.
- Information you give us (including account details) must be true and kept up to date.
- One person per account. You must not share your account or sign-in details. You are responsible for everything done under your account.
- An account can be signed in on up to 3 devices at a time.
- Tell us straight away at [email protected] if you think someone else has used your account.
- For security, an account is locked after 5 failed sign-in attempts and must be unlocked by resetting the password.
2. What the Service is – and is not
- The Service lets you lay out a room, choose finishes and products, and produce computer-generated photos and videos (“Renders”).
- Renders are artistic illustrations. Colours, textures, lighting, gloss, scale and product appearance will differ from real life and between screens.
- Measurements, tile quantities, layouts and any prices are estimates only. They do not account for site conditions, wastage, set-out, falls, substrate, building codes or Australian Standards (including AS 3740 waterproofing and the National Construction Code).
- Products shown may be discontinued, unavailable, changed or priced differently by the supplier. Inclusion of a product is not an endorsement by that supplier or by us, and suppliers are not responsible for the Service.
- You must not rely on the Service as the sole basis for purchasing, construction, contracts or quotes.
3. Payments, credits and subscriptions
- Some features (such as Renders) cost money. Prices are shown in Australian dollars and include GST where applicable, before you confirm a purchase. Payments are handled by Stripe; we never see or store your card details.
- Free image: a new account can make one free image, which carries a watermark. It is limited to one per person and device, and we may refuse it where it looks like the limit is being avoided.
- Pay as you go: you buy renders in advance. They are used when a render starts and do not expire.
- Monthly plans: renew automatically each month until you cancel. Each month’s credits are added to your account. Unused plan credits do not expire: they stay until you use them, including after you cancel, unless the account is closed or the payment they came from is refunded or reversed. You can cancel any time in your account; your plan keeps working until the end of the month you have paid for. Moving to a bigger plan applies straight away; moving to a smaller plan applies from your next renewal.
- Collecting your renders: a render is charged once its pictures or video have been made, whether or not you come back for them. Finished renders are not stored: keep the page open, or come back within 25 minutes of the render finishing, and the app collects it. After that it is gone and the render is not returned.
- Failed renders: if nothing could be made (a fault on our side), the render is returned to your account automatically, usually within an hour. If a picture comes back faulty, send us a screenshot of it through Messages in the app within 14 days; if we confirm the fault, we return the render to your account. If you stop a render before it finishes, pictures already made are charged and the rest are returned.
- Refunds: we do not refund unused renders or credits, part-months of a plan, or purchases you change your mind about. This does not limit your rights under the Australian Consumer Law: if the Service has a fault, we will fix it or refund you as that law requires (see section 9). To ask, use Messages in the app.
- We may change prices with at least 14 days’ notice for plans; changes never affect renders or credits you have already paid for.
- Chargebacks or payment disputes made without first contacting us may lead to the account being suspended while we investigate.
4. Acceptable use
You must not, and must not help anyone else to:
- break any law, or use the Service to mislead or deceive anyone (for example presenting a Render as a photo of completed work, or as a supplier’s official image);
- copy, resell, sublicense or rebrand the Service, or let people who are not account holders use it through your account;
- access the Service by automated means (bots, scrapers, scripts), overload it, or try to get around usage limits, credit checks or security;
- try to reverse-engineer, decompile or copy the Service’s software, or extract the product catalogue or its images;
- upload or enter anything unlawful, offensive, or that infringes someone else’s rights;
- interfere with other users or with our systems or providers.
We may set fair-use limits (for example on the number, size or length of Renders) to keep the Service reliable and affordable for everyone.
5. Your content
- You keep ownership of the designs you create and the Renders you produce (“Your Content”), subject to the rights of suppliers and others in the products and images shown in them.
- You give us a limited licence to process Your Content only as needed to run the Service (for example to produce a Render). We will not use Your Content for marketing or show it publicly without your written permission.
- You may use your Renders for personal use and to present designs to your own clients. You must not use supplier trademarks or product images in a way that suggests the supplier endorses you or your business.
- You are responsible for keeping copies of your designs and Renders. Designs are stored on your device and may be lost if you clear your browser or change devices.
6. Our property
The Service, its software, design, name and logo belong to us or our licensors. Supplier names, logos, product names and images belong to their owners and are used with permission or for identification. Apart from the rights in section 5, these terms do not give you any rights in them.
7. Availability and changes
- We aim to keep the Service running but do not promise it will always be available, uninterrupted, error-free or that Renders will finish within a particular time.
- We may change, add or remove features. We will give reasonable notice of changes that significantly reduce what paying users receive.
8. Suspension and closing accounts
- You can close your account at any time by contacting us through Messages in the app or at [email protected].
- We may suspend or close an account, without refund of affected credits, if you seriously or repeatedly break these terms, misuse the Service, or if we must do so by law. Where reasonable we will warn you first.
- If we close the Service entirely, we will give at least 30 days’ notice and refund unused prepaid credits and the unused part of any subscription.
9. Australian Consumer Law
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or changes those rights. Where the law allows us to limit our liability for a failure to meet a guarantee, our liability is limited to supplying the services again or paying the cost of having them supplied again.
10. Limits on our responsibility
To the maximum extent permitted by law:
- the Service and all Renders, estimates and product information are provided “as is”;
- we are not liable for any loss arising from reliance on Renders, measurements, quantities, prices or product information, including the cost of materials, building work, rework, delays, or disputes with clients, builders or suppliers;
- we are not liable for indirect or consequential loss, or loss of profit, revenue, data, business or goodwill;
- our total liability to you for all claims relating to the Service is limited to the amount you paid us in the 12 months before the claim arose.
11. Indemnity
To the extent permitted by law, you agree to cover our reasonable losses and costs caused by your breach of these terms, your misuse of the Service, or your use of Renders with your clients or third parties.
12. Privacy
Our Privacy Policy explains how we handle personal information and forms part of these terms.
13. Changes to these terms
We may update these terms. We will change the date at the top and give account holders at least 14 days’ notice of material changes by email or in the app. If you keep using the Service after the change takes effect, the new terms apply; if you do not agree, you can close your account and we will refund unused prepaid credits.
14. General
- These terms are governed by the laws of Victoria, Australia, and you and we submit to the courts of Victoria.
- If part of these terms is invalid, the rest still applies.
- If we do not enforce a right straight away, we have not given it up.
- You may not transfer your account or these terms to anyone else. We may transfer them to a buyer of the business, who must honour them.
